Friday is an employee well-being check-in platform that helps organisations collect simple employee feedback, analyse trends, and generate recommendations and insights.
Document Hierarchy
If documents conflict, the order of precedence is: signed customer agreement/order form, DPA, Terms, Privacy Policy, website/product descriptions.
Customers And Users
A "Customer" is the organisation that buys or configures Friday for its workplace.
A "User" is an employee, manager, administrator, or other person invited to use Friday.
If you create, configure, administer, or use a Friday account on behalf of an organisation, you represent that you have authority to act on behalf of that organisation and to bind it to these Terms or the applicable agreement.
Customer Responsibilities
Customers are responsible for:
- Ensuring they have a lawful basis to invite users and process workplace data in Friday.
- Providing employees and users with appropriate workplace notices, consultation, and information before using Friday, including explaining the selected feedback visibility mode, who may access insights, and how outputs may and may not be used.
- Configuring teams, roles, permissions, feedback visibility modes, and check-in settings correctly.
- Keeping employee lists and access permissions accurate.
- Deciding how to act on insights, reports, and recommendations.
- Not using Friday for recruitment, selection, promotion, termination, compensation, disciplinary decisions, performance scoring, or automated monitoring/evaluation of individual employee performance.
- Complying with employment law, data protection law, and workplace consultation obligations that apply to them.
User Responsibilities
Users must:
- Use Friday only for lawful workplace purposes.
- Provide accurate information where required.
- Avoid submitting content that is unlawful, discriminatory, harassing, threatening, defamatory, or irrelevant to workplace well-being.
- Avoid submitting unnecessary sensitive personal data about themselves or others.
- Keep login links, credentials, and account access secure.
Acceptable Use
Users and customers must not:
- Attempt to access data or accounts they are not authorised to access.
- Interfere with the security, integrity, or availability of Friday.
- Reverse engineer, scrape, overload, or misuse the service.
- Upload malware or harmful code.
- Use Friday for unlawful monitoring, surveillance, discrimination, harassment, or retaliation.
- Use Friday outputs, scores, feedback, recommendations, reports, or insights as the sole, primary, or determinative basis for hiring, firing, promotion, compensation, discipline, performance evaluation, or other decisions that may significantly affect an employee.
- Use Friday for recruitment, selection, promotion, termination, compensation, disciplinary decisions, performance scoring, or automated monitoring/evaluation of individual employee performance.
AI And Recommendations
Friday may use AI to analyse feedback, identify themes, and generate recommendations. AI outputs are decision-support only and may be incomplete or inaccurate. Customers and users must apply human judgement before acting on any recommendation or insight.
Friday does not provide HR, employment, legal, medical, psychological, compliance, or professional advice.
No Automated Employment Decisions
Friday is designed as a feedback, reflection, and decision-support tool. Friday must not be used to make automated employment decisions or as the sole, primary, or determinative basis for decisions about hiring, firing, promotion, compensation, discipline, performance evaluation, or other decisions that may significantly affect an employee.
Friday is not designed, authorised, or intended for recruitment, selection, promotion, termination, compensation, disciplinary decisions, performance scoring, or automated monitoring/evaluation of individual employee performance. Customers must not use Friday for these purposes.
Data Protection
Friday processes personal data as described in the Privacy Policy. For customer workplace data, Friday normally acts as data processor and the customer acts as data controller. A data processing agreement may apply and controls the processing of customer workplace data where required.
Subscriptions And Payment
Access to paid Friday services may require a subscription, order form, invoice, or written agreement. Fees, payment terms, subscription period, renewal, and cancellation terms are stated in the applicable order form, invoice, or written agreement.
Unless stated otherwise, fees are exclusive of VAT and other taxes. Payment is due according to the invoice. Payments are non-refundable unless required by law or agreed in writing.
Late payment of undisputed fees may lead to suspension after reasonable notice. Renewal and cancellation follow the order form, invoice, or written agreement. If none exists, there is no automatic renewal unless agreed.
Support
Friday provides support through its normal support channels. No specific response time, uptime commitment, or service level applies unless agreed in writing.
Availability And Changes
Friday may improve, modify, suspend, or discontinue parts of the service. We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free availability.
Beta Or Trial Features
Friday may offer beta, pilot, or trial features. These may change, break, or be removed and should not be relied on for critical decisions.
Intellectual Property
Friday and its software, design, branding, content, models, workflows, and documentation belong to Friday or its licensors. Customers and users receive a limited right to use Friday according to these Terms and any applicable agreement.
Customer Data
Customers and users retain ownership of the data they submit to Friday, subject to the rights needed for Friday to provide, secure, support, and improve the service according to the applicable agreement and Privacy Policy.
Public Logo Use
Friday may use a customer’s name or logo publicly only with the customer’s prior consent, unless otherwise agreed.
Confidentiality
Non-public information exchanged between Friday and a customer must be protected with reasonable care and used only for the relationship or service.
Confidentiality obligations survive termination. Confidential information may be disclosed to professional advisers, auditors, authorities, courts, regulators, or other recipients where required by law, necessary to protect rights, or permitted by the applicable agreement.
Disclaimers
Friday is provided on an "as is" and "as available" basis to the extent permitted by law. Friday does not guarantee that insights or recommendations will identify every workplace issue or produce any specific business, HR, well-being, or productivity outcome.
Liability
To the extent permitted by law, Friday is not liable for indirect loss, loss of profits, loss of business, loss of goodwill, loss of data, or consequential damages.
To the maximum extent permitted by law, Friday’s total aggregate liability arising out of or relating to the service is limited to the fees paid by the customer to Friday during the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, wilful misconduct, gross negligence, or mandatory statutory rights.
Any liability terms in a signed customer agreement, order form, or Data Processing Agreement take precedence over this section where they conflict.
Data Export And Termination
Customers may request export of customer data before termination or within a reasonable period after termination. Deletion follows the Privacy Policy, DPA, or applicable agreement.
Termination
Customers may stop using Friday according to their applicable agreement. Friday may suspend or terminate access if a customer or user materially breaches these Terms, creates security risk, fails to pay undisputed fees after reasonable notice, or uses the service unlawfully.
Upon termination, the customer may request export or return of customer data for a limited period before deletion, unless otherwise agreed in writing. Friday may delete customer data according to the applicable agreement, Data Processing Agreement, Privacy Policy, and legal requirements. Unless otherwise agreed or legally required, production personal data is deleted within 30 days after termination of the customer relationship, and backups are deleted automatically within a maximum of 90 days.
Governing Law
These Terms are governed by Danish law, unless mandatory law says otherwise. Courts in Denmark have jurisdiction unless otherwise agreed in writing.
Changes
Friday may update these Terms from time to time. Material changes will be communicated by updating the effective date and, where appropriate, notifying customers or users.
